Bathroom Design Terms & Conditions

1. References in these Terms and Conditions to "We/ Us/ Our" are references to William Wilson Limited. References to "You/ Your" are references to the individual or company using the Design Service.
    
2. We agree to create and provide You with bathroom design plans and illustrations (“Designs”) in accordance with these Terms and Conditions (“Design Service”).
    
3. Designs are provided as a guidance tool and for illustrative purposes only.   The Designs do not, and are not intended to, form part of any contract.
    
4. The Designs may include alternative products to those You have selected.  These are used for illustrative purposes only.
    
5.  The Design Service is free.  We do not warrant or give any representations regarding the use, or the results of the use, of the Designs.  We do not warrant that the Designs are correct, accurate, reliable or otherwise.
    
6. The Designs are based on measurements You provide to Us.  You must check your measurements with your installer before any products are ordered.
    
7. By using the Design Service, You accept that You are solely responsible for the accuracy and content of any information provided to Us.   You agree to:
    

• check the accuracy of the information provided and satisfy Yourself that it meets Your needs;
• ensure any Design is suitable for use, based on site conditions and needs; and
• arrange preparation of separate final design drawings and details suitable for the site.
   

8. We reserve the right, at Our sole discretion, to amend or withdraw the Design Service without notice.
    
9. Errors and omissions of a clerical nature are liable to corrections without any liability to Us.
    
10. The copyright, design rights and other rights in the Designs (including but not limited to drawings, plans and other items supplied by Us) belong to Us.  You have no rights in respect of them. You may not copy or reproduce, or allow to be copied or reproduced, Our Designs.
     
11. We do not accept responsibility if the Designs are used by parties other than Us or Our employees or agents.
     
12. All dimensions are subject to final survey.  It may be necessary to amend the dimensions and layout to suit final dimensions and conditions.
     
13. Setting out dimensions are based on the assumptions all walls, ceilings and floors are straight and level.  We are not responsible for variations in heights, widths and depths of the furniture relative to these structures should this not be the case following any final survey.
     
14. Do not scale off the Designs.  Please check all measurements before fitting and installation
    
     
15. To the extent permitted by law, We hereby exclude all liability for any claim, loss, demands or damages of any kind whatsoever (whether such claims, loss, demands or damages were foreseeable, known or otherwise) arising out of or in connection with Your use of the Design Service and the Designs including without limitation, indirect or consequential loss or damage; loss of actual or anticipated profits (including loss of profits on contracts); loss of revenue; loss of business; loss of opportunity; loss of anticipated savings; loss of goodwill; loss of reputation; loss of, damage to, or corruption of data; loss of use of money or otherwise, and whether or not advised of the possibility of such claim, loss, demand or damages and whether arising in tort (including negligence), contract or otherwise. In respect of individual users, this statement does not affect Your statutory rights
     
16. Nothing in these Terms and Conditions excludes or limits Our liability for anything which may not be limited or excluded by law.
     
17. The use of the Design Service is governed by Scottish Law and You and Us irrevocably submit to the non-exclusive jurisdiction of the Scottish courts.
